Eudorans face preliminary hearings
The alleged criminals in two Eudora cases had first appearances in Douglas County Court last week.
Jill S. Lavin was charged with two counts of arson and one count of making a false writing. Her home in west Eudora caught fire three times in two months. Her preliminary hearing date is set for Sept. 20 at 2 p.m.
Three men charged with running a commercial gambling operation out of the Guilded Cage in Eudora will also face a preliminary hearing Sept. 20 at 2 p.m. Even though Gerald K. Dunavin and Larry O. Stewart, Eudora, and Michael L. Garber, McLouth, will go to preliminary trial together, that doesn't mean they'll be tried together, said Douglas County District Attorney Christine Kenney.
"It's fairly common to handle these cases together," she said.
Kenney said preliminary hearings are where the state shows the court there is probable cause, and therefore enough evidence to put the accused on trial.
"We're not required the same burden of proof," Kenney said. "Our burden of proof is not the same as for a trial. That's beyond a reasonable doubt.
